March 19, 2009

Home Care License Rule Passes on March 18th in two hour rule-making hearing: 
HCAC presented testimony before the State Board of Health on industry data. Member providers from various industry sectors and geographic areas including home health, private duty, non-medical personal care, county health dept., IHSS and PACE explained what their agencies do and who their clients are. One amendment passed to clarify how PACE and IHSS programs will coordinate with the Dept. of Health Care Policy & Financing. Another amendment to clarify how long agencies have to begin producing requested documents during survey was postponed to the April 15th hearing. There was much interest by Board members regarding tightening up the criminal background check process and formally acknowledging those agencies that are accredited by national accrediting organizations. Both topics may require further legislative authority.

The home care licensure fee schedule will be considered at the Board's April 15th meeting. Watch here for details.

 

March 14, 2009

Rule Making Hearing Details:  The Home Care Agency Licensure rulemaking hearing is set for Wednesday, March 18, 2009 before the State Board of Health at 10 a.m. at the Colorado Dept. of Public Health & Environment, 4300 Cherry Creek Drive South, Sabin-Cleere Conf. Room, Denver, CO 80246.

HCAC learned last week that the fee schedule will not be considered at this hearing because it was not "noticed" to the public by the deadline. Instead it will be heard at the Board's April 15th meeting. It is unclear at this time whether comments regarding the fee schedule will be accepted on March 18, but the rest of the rule will be fully discussed at that time.

Read Proposed Home Care Licensure Fees (distributed on February 13th by the Dept. of Public Health & Environment.)
The latest proposed fee schedule creates six tiers of licensure, based on wages paid to direct care staff as verified by the most recent workers compensation insurance audit or equivalent report. The fee schedule also incorporates a performance incentive as requested by HCAC. It does not include other HCAC recommendations below.

Click here to read Department of Health's 12/31/08 proposed home care licensure fee proposal. Annual licensure renewal fees range from $2,434 per year for certified medical (skilled) agencies to $3,567 per year for non-certified medical agencies; and from
$1,900 per year for certified non-medical personal care agencies to $2,580 per year for non-certified personal care agencies. An additional $600 will be levied for non-certified initial applicants and for agencies with branch offices and/or large service areas.

Home Care Licensure Rule Making: The HCAC worked with the Colorado Dept. of Public Health and Environment to write and pass a sound home care licensure bill in the 2008 session of the Colorado General Assembly. Before the new law can be implemented, rules must be written. Representing HCAC on the Home Care Agency Licensure Advisory Committee are Sonya Neumann, Physicians Home Health, with locations in Colorado Springs, Pueblo and Denver; David Johnston, Argus Health Network, with locations in Pueblo, Denver and Canyon City; Donna Floyd, Interim HealthCare of Western Colorado, Grand Junction and Crag Business Group, Delta. All are members of the HCAC Board of Directors. Other HCAC members serving on the 14-person committee are Tiffany Walters, Maxim / Max-Health, with locations in Aurora, Colorado Springs, Fort Collins, LaJunta, Pueblo and Westminster, and Leanne Smiley, Total Longterm Care / PACE program, Denver.

During the 2008 Legislative Session:

HCAC's Position regarding the passage of the Licensing Bill, SB 08-153: "Support." This bill is being brought forth by the Colorado Dept. of Public Health and Environment in response to reported harm to consumers by certain certified home health agencies that could not be addressed by Medicare survey / certification process.

HCAC has been working with the Dept. since early November 2007on amendments including:
1. Coverage of all entities that provide home care services in Colorado
2. Ensure the least amount of regulatory burden and cost to home care agencies.
3. Provide reduced licensure fees for Medicare and Medicaid certified agencies.
4. Prohibit duplicate survey and reporting requirements for certified agencies.
