Governor Ritter Signs Home Care Licensing Act
SB 08-153, sponsored by Sen. Betty Boyd, (D-Lakewood), and Rep. Mark Ferrandino (D-Denver), was guided and monitored by HCAC's Board of Directors, Legislative Advocacy Council and the association's lobbyists. The short title of the bill was: "To License Home Care Agencies by the CDPHE." The HCAC position on the legislation was to support with amendments as suggested by the home care industry. This bill was brought forth by the Colorado Dept. of Public Health and Environment in response to reported harm to consumers by certain certified home health agencies that could not be addressed by the Medicare survey / certification process.HCAC has been working with the Dept. since early November on amendments including: 1. Coverage of all entities that provide home care services in Colorado; 2. Ensure the least amount of regulatory burden and cost to all home care agencies, whether Medicare certified or not; 3. Provide reduced licensure fees for Medicare and Medicaid certified agencies; 4. Prohibit duplicate survey and reporting requirements for certified agencies.
