An Overview...

Many regulators of providers, including The Centers for Medicare and Medicaid Services (CMS) and state licensure organizations, are serious about taking action against substandard wound care. Private attorneys representing patients and/or their families are more likely to initiate lawsuits based on substandard wound care than they were in the past. Practitioners, therefore, face a number of potentially problematic areas related to wound care that may result in regulatory action and/or private lawsuits. These areas include:  liability for adverse payment decisions, liability for substandard wound care, fraud and abuse, decertification/loss of licensure, disciplinary proceedings against individual practitioners, liability for termination of services/abandonment, and criminal prosecution. The purpose of this presentation is to educate providers about legal risks associated with wound care and to provide practical strategies for avoiding liability associated with this type of care.

Objectives:

  • List four requirements necessary to prove negligence;

  • Describe two common types of negligence related to wound care;

  • Identify one type of fraud and abuse related to wound care, and

  • List three requirements necessary to prove abandonment.
